Terms of Service

1. Acceptance of Terms

1.1 These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and FujiCraft ("we," "us," "our"), governing your access to and use of our webstore, Minecraft game server network, email-based support system, and associated services (collectively, the "Services").

1.2 By accessing the Store, connecting to the Server, or submitting a support request, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policies, Refund Policy, and Support Policy, all of which are incorporated herein by reference.

1.3 If you do not agree to these Terms, you must immediately cease using the Services.

1.4 If you are under the age of eighteen (18), or under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Eligibility and Account Identification

2.1 The Services are available to users worldwide, subject to applicable local laws. You represent that your use of the Services does not violate any law applicable to you.

2.2 There is no traditional account registration system. Your purchases and in-game entitlements are associated with your Minecraft username, UUID, and the email address provided at checkout. You are responsible for ensuring the accuracy of this information.

2.3 You may not purchase items on behalf of another user's Minecraft account without their authorisation. You accept full responsibility for purchases made using your email address.

3. Minecraft Server Access

3.1 Access to the Server is provided at our sole discretion. We reserve the right to deny, suspend, or permanently revoke access to any user for any reason, including but not limited to violations of these Terms, Mojang's EULA, or our community rules.

3.2 Connecting to the Server constitutes consent to our Server Privacy Policy and to reasonable monitoring of your activity for the purposes of security, anti-cheat enforcement, and moderation.

3.3 We operate in accordance with Mojang Studios' Commercial Usage Guidelines. The Server is not affiliated with, endorsed by, or operated in partnership with Mojang AB or Microsoft Corporation.

4. Digital Goods and Virtual Items

4.1 All items available for purchase through the Store — including ranks, cosmetics, perks, subscription benefits, and in-game currency (collectively, "Virtual Items") — are digital goods licensed to you on a non-exclusive, non-transferable, revocable basis solely for personal, non-commercial use on the Server.

4.2 Virtual Items have no monetary value outside the Server. You may not sell, trade, transfer, or assign Virtual Items to other users except through mechanisms explicitly provided by us.

4.3 Virtual Items do not constitute property. You acquire no ownership interest in any Virtual Item. Your access to Virtual Items is contingent upon your continued compliance with these Terms.

4.4 We reserve the right to modify, rebalance, discontinue, or remove any Virtual Item at any time without prior notice and without liability, provided that such changes are made in good faith.

4.5 In the event of permanent discontinuation of the Server, Virtual Items will cease to have effect. We will endeavour to provide reasonable advance notice of service closure.

5. Purchases and Payment

5.1 All purchases made through the Store are processed by Stripe, Inc. We do not collect, store, or have access to your full payment card details. By completing a purchase, you also agree to Stripe's Terms of Service and Privacy Policy.

5.2 All prices are displayed in the currency shown in the Store. You are responsible for any applicable taxes, import duties, or currency conversion fees imposed by your financial institution.

5.3 By completing a purchase, you authorise us to charge the specified amount to your designated payment method via Stripe.

5.4 We reserve the right to modify pricing at any time. Changes in pricing do not affect already-processed transactions.

6. Recurring Subscriptions

6.1 Certain Virtual Items are offered on a recurring subscription basis ("Subscription"). Subscriptions automatically renew at the end of each billing cycle unless cancelled in accordance with Section 6.3.

6.2 By purchasing a Subscription, you authorise us to charge your payment method on a recurring basis at the disclosed interval until cancellation.

6.3 Subscriptions may be cancelled at any time by submitting a written cancellation request to fujicraftmc@gmail.com from the email address associated with the Subscription. Cancellation is subject to email verification and will take effect at the end of the current billing cycle.

6.4 Cancellation of a Subscription does not entitle you to a prorated refund for the remainder of the current billing period, except as required by applicable law or as provided in our Refund Policy.

6.5 Failure of payment on a renewal date may result in immediate suspension of Subscription benefits. We are not liable for any lapse in benefits resulting from failed payment.

6.6 We reserve the right to discontinue a Subscription tier with thirty (30) days' written notice. In such cases, any prepaid amounts covering the period following discontinuation will be refunded on a prorated basis.

7. Fraud Prevention and Chargebacks

7.1 We actively monitor transactions for fraudulent activity. We reserve the right to cancel orders and refuse service where fraud is suspected.

7.2 Initiating a chargeback or payment dispute without first making a good-faith attempt to resolve the issue through our Support Channel constitutes a material breach of these Terms.

7.3 In the event of a fraudulent or unjustified chargeback ("friendly fraud"), we reserve the right to:

• Immediately and permanently revoke all Virtual Items and entitlements associated with the disputed account(s);
• Permanently ban the associated Minecraft username(s) and email address(es) from the Server and Store;
• Submit documentation to Stripe and your financial institution contesting the chargeback;
• Pursue recovery of amounts including chargeback fees imposed on us by Stripe or payment processors.

8. Bans and Revocation of Entitlements

8.1 We reserve the right to ban any user from the Server for violations of our community rules, these Terms, or Mojang's EULA. Bans may be temporary or permanent at our discretion.

8.2 A ban from the Server does not automatically entitle the banned user to a refund of any purchases made prior to the ban, except as required by applicable law.

8.3 We reserve the right to revoke, suspend, or modify any Virtual Item or entitlement, without refund, where the user has materially violated these Terms; engaged in cheating or exploitation; where the purchase was made fraudulently; or where the entitlement was obtained through misrepresentation.

9. Prohibited Conduct

9.1 You agree not to use cheats, hacks, bots, exploits, or unauthorised modifications on the Server; harass, threaten, abuse, or discriminate against other users or staff; attempt to circumvent bans through alternate accounts or IP addresses; use the Services for any unlawful purpose; attempt to reverse-engineer or interfere with our systems; misrepresent your identity or impersonate another user or staff member; or exploit pricing errors, technical bugs, or unintended mechanics for material gain.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED BY LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE OR FOR FRAUDULENT MISREPRESENTATION.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FUJICRAFT, ITS OPERATORS, STAFF, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT PERMIT EXCLUSION OR LIMITATION OF CERTAIN LIABILITIES; IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MINIMUM EXTENT PERMITTED BY APPLICABLE LAW.

12. Indemnification

12.1 You agree to indemnify, defend, and hold harmless FujiCraft, its operators, staff, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your breach of these Terms, your use of the Services in violation of applicable law, or any fraudulent, abusive, or tortious conduct by you in connection with the Services.

13. Termination

13.1 We may suspend or terminate your access to the Services at any time, with or without notice, for any breach of these Terms or for any other reason in our sole discretion.

13.2 Upon termination, all licences granted to you are immediately revoked. Provisions that by their nature should survive termination shall continue in full force and effect.

14. Modifications to Terms

14.1 We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date and posting notice on the Store. Your continued use of the Services after such changes constitutes acceptance.

15. Governing Law and Dispute Resolution

15.1 These Terms shall be governed by and construed in accordance with the laws of [GOVERNING JURISDICTION], without regard to its conflict of law provisions.

15.2 Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of [JURISDICTION], except where mandatory consumer protection law in your jurisdiction provides otherwise.

15.3 Nothing in this section prevents you from asserting rights under applicable mandatory consumer protection legislation in your country of residence.

16. Severability and Entire Agreement

16.1 If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16.2 These Terms, together with our Privacy Policies, Refund Policy, and Support Policy, constitute the entire agreement between you and us with respect to the Services.
